VILLAGE OF TAOS SKI VALLEY

ORDINANCE NO. 06-42

AN ORDINANCE IMPOSING A TEMPORARY MORATORIUM ON THE ISSUANCE OF BUILDING PERMITS WITHIN

THE VILLAGE OF TAOS SKI VALLEY

            Whereas, there has been a significant increase in the planning and development of new structures within the Village of Taos Ski Valley and these structures will need to be connected to the Village’s wastewater treatment plant; and

            Whereas, the Village’s existing US Forest Service permit only allows the Village to discharge 95,000 gallons per day into the Rio Hondo; and

            Whereas, the planned development occurring within the Village would, if connected to the system, cause the Village to significantly exceed the amount of water discharged as allowed by the US Forest Service; and

            Whereas, the Village needs additional time to determine if the Village will be allowed an increase in the amount of water to be discharged by the US Forest Service; and

            Whereas, restricting the issuance of building permits will allow the Village to decide in an intelligent manner how best to allocate the available sewer connections, while assuring that structures are not built that cannot be hooked up to the Village’s wastewater system; and

            Whereas, the Village is in the process of hiring a Planner to assist it in these tasks and needs additional time to study the process and adopt regulations.

NOW, THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THE VILLAGE OF TAOS SKI VALLEY that a temporary moratorium of six months duration is hereby imposed on the issuance of new building permits to allow the Village to adopt regulations to allocate the limited amount of waste water that can be discharged under the US Forest Service permit. Exemptions from the requirements of this ordinance may be granted by the Village’s Planning and Zoning Commission upon showing that the new construction will not increase the number of sewer connections that are currently in use by the property.
