VILLAGE OF TAOS SKI VALLEY
ORDINANCE NO. 06-43
AN ORDINANCE REQUIRING A CONDITIONAL USE PERMIT ON CERTAIN NEW SEWER CONNECTIONS WITHIN THE VILLAGE OF TAOS SKI VALLEY
Whereas, the Village of Taos Ski Valley has completed the construction project to the wastewater treatment facility to handle the projected increase in wastewater and sewage generated within the Village; and
Whereas, even with the new construction to the wastewater treatment facility, the Village has limited capacity to treat wastewater at the facility; and
Whereas, the Village has commissioned a study of development within the Village; and
Whereas, the Village needs to provide regulations through which developers may plan their projects and receive approval from the Village and through which the Village can assess its ability to treat any wastewater discharged by the project.
NOW, THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THE VILLAGE OF TAOS SKI VALLEY that any proposed construction that has not previously been granted a conditional use permit and that is projected to discharge 750 or more gallons of wastewater per day of peak flow per acre will be required to obtain a Conditional Use Permit and demonstrate that its proposed wastewater discharge can be treated by the Village. These requirements shall remain in effect until the Village is able to adopt new Subdivision and Zoning Regulations that govern the discharge of wastewater.
Ordinance No. 06-42, an Ordinance Imposing a Moratorium on the Issuance of Building Permits is in conflict with this Ordinance, it is hereby repealed.
I declare that there is an immediate danger to the health, safety and welfare of the people of the Village of Taos Ski Valley that require that this ordinance be effective immediately.
