TAOS SKI VALLEY
AMENDED
ORDINANCE NO. 97-10
AN ORDINANCE
ADOPTING THE NEW MEXICO BUILDING CODE BY REFERENCE; MODIFYING THE NEW MEXICO
BUILDING CODE; REPEALING ALL ORDINANCES OR PARTS THEREOF IN CONFLICT HEREWITH;
DECLARING AN EMERGENCY.
BE IT ORDAINED
BY THE GOVERNING BODY OF THE VILLAGE OF TAOS SKI VALLEY, NEW MEXICO:
SECTION
1. ADOPTION BY REFERENCE.
The New Mexico Building Code
(CID-GCB-NMBC-91-1), and all subsequent amendments as they may be promulgated
and adopted by the State of New Mexico and such additions and modifications as
the Village may adopt, (hereinafter "New Mexico Building Code") are
herewith adopted by reference, pursuant to Section 3-17-6 NMSA, 1978.
SECTION
2. ADDITIONS AND MODIFICATIONS.
The New Mexico Building Code is
modified as follows:
A. Fees and permits referred to in Section
304 shall be collected in accordance with Table No. 3-A of the 1991 Uniform Building Code which is hereby adopted
by reference; and,
B. When the word (s) "City",
"City Ordinance", "this Ordinance", or like phrases appear
in the New Mexico Building Code, it shall mean the Village of Taos Ski Valley;
and,
C. When reference is made to the word
(s)
"Bureau", it shall mean the Village of Taos Ski Valley; and,
D. When reference is made to the word
(s)
"building official" it shall mean and refer to the Village of Taos
Ski Valley’s Administrator or his duly appointed representative.
E. In Section 302.(e) the word “two” shall
be replaced with the word “three”. This
change will require the submittal of three sets of plans. Two sets of plans will be retained by the
Village.
SECTION
3. SEVERABILITY.
Should any section, paragraph, clause
of provision of this ordinance, for any reason, be held to be invalid or
unenforceable, the invalidity or enforceability of such section, paragraph,
clause of provision shall not affect any of the remaining provisions of this
ordinance.
SECTION
4. REPEAL.
Ordinance 97-10 and any other
ordinances or resolutions, or parts thereof, inconsistent herewith are hereby
repealed to the extent only of such inconsistency. The repealer shall not be construed to revive any ordinance or
resolution, or part thereof, heretofore repealed.
SECTION
5. EMERGENCY CLAUSE.
The Village finds and declares an
emergency exists because of the lack of a Building Code and that this amended
ordinance shall be effective upon passage and publication.
